1. Introduction Welcome to 3AM (the "App"), a mobile application developed by Shuyao Zhu (the "Developer") for making fanfiction reading more enjoyable. By downloading and using the App, you agree to these Terms of Service ("Terms") and our Privacy Policy.
2. Eligibility To use the App, you must be at least 17 years old. If you are under 17, please do not use the App.
3. Content Rights The App is designed to enhance the fanfiction reading experience by providing an intuitive interface for discovering stories, reading comfortably, and tracking progress on-the-go. The App allows users to access fanfiction and other content on Archive of Our Own ("AO3") in a manner similar to a web browser. When users open a work or submit a search query, the mobile device fetches data directly from AO3's servers. The Developer respects the rights of the creators and owners of the content, and does not host, scrape, endorse, or claim ownership of the content accessible through the App. The App provides user-friendly mechanisms for readers to visit and engage on AO3.
4. User Conduct You agree that you will only use the App for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct while using the App. The Developer will not be held liable for any illegal activities or harm caused by your actions. You agree that you will not copy, reproduce, modify, or distribute the App or any part thereof without the prior written consent of the Developer. You also agree not to damage or attempt to damage the intellectual property of the Developer, including but not limited to, trademarks, copyrights, and trade secrets.
5. Subscriptions
   • The App offers subscription plans which unlocks advanced app features. You can view the benefits associated with the subscriptions in Settings within the app.
   • Some app features offered through subscriptions require a stable internet connection to archiveofourown.com. Please note that archiveofourown.com may be blocked in certain countries, and users located in these countries will not be able to use these features. Before subscribing, the Developer recommends verifying if this may apply to you.
   • The Developer reserves the right to modify the price and benefits associated with the subscriptions at any time without prior notice. In the unlikely event of price increase or benefit reduction, the Developer will make reasonable efforts to inform subscribers of such changes before they take affect. The manner and timing of such notifications are at the Developer's sole discretion.
   • All transactions related to your subscription, including purchases and refunds, are handled by Apple. As such, any disputes or issues with your subscription should be directed to Apple's customer support team.
6. No Warranty The Developer provides the App "as is" and without warranty of any kind, express or implied. You use the App and consume the content available through the App at your own risk. The Developer disclaims all warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
7. AO3's Terms Given that the App's primary functionality is facilitating accessing AO3, the Developer encourages you to review and agree to AO3's Terms and Conditions before using the App.
8. Changes to These Terms The Developer reserves the right to modify or update these Terms at any time without notice. Your continued use of the App after changes are made will constitute your acceptance of the revised Terms.
9. Dispute Resolution If you have any concern or dispute about the App, you agree to first try to resolve the dispute informally by contacting the Developer.
10. Limitation of Liability In no event will the Developer or its affiliates be liable to you or any third party for any damages, including but not limited to, direct, indirect, incidental, consequential, or punitive damages, arising out of your use of or inability to use the App, even if the Developer has been advised of the possibility of such damages. You agree that this limitation of liability applies to all claims, whether based on contract, tort, or other theories of liability.
11. Entire Agreement These Terms constitute the entire agreement between you and the Developer regarding your use of the App. If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed from the remaining provisions, which will remain in effect.

By downloading and using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
